WARRANTY STATEMENT

SmartDC Inc warranties its products to be free from defects in materials and workmanship and to perform under normal and proper use for a period of five (5) years from purchase. SmartDC’s only obligation is to correct such defects by repair or replacement of the products, at its option. There are no implied warranties of any kind, including merchantability and fitness for a particular purpose, but if any implied warranty is required by the applicable jurisdiction, the duration of any such implied warranty is limited to five years. The total liability of SmartDC on any and all claims of any kind, including but not limited to warranty claims, shall in no event exceed the purchase price of the product(s) that give rise to the claim. This warranty does not cover incidental or consequential damages arising out of, or in connection with, the use or performance of this product or other indirect damages with respect to loss of property, revenue or profit, or cost of removal, installation or re-installation.

PRICING

Prices are subject to change without notice. In the event of price increases, all in house orders will be filled at lower prices provided orders are released for shipping prior to the price increase.

SALES TAX

We are required to collect and remit sales tax on shipments into the states of TX unless the purchaser supplies us with a signed official state resale certificate or sales tax exemption certificate with the order. Receiver is responsible to collect and remit sales tax, if any, and any other taxes as required by that state for shipments to states other than those listed above.

ORDER CANCELLATION CHARGE

Cancellation of any order must be authorized prior to shipment to avoid cancellation and/or return charges. Orders requiring any custom components, programming, or features may not be canceled. If a delivery is refused at destination; warehousing, delivery and return costs will be charged to the customer.

PRODUCT SPECIFICATION & APPROVAL

Product specifications are subject to change without notice. The acceptance and approval of our products for individual project specifications is not warranted by our company.

PAYMENT TERMS

We accept Visa, Mastercard & Amex and there will be a 3% convenience fee on all credit card payments. Credit card payments will be accepted for invoices totaling less than $1,000 only. Note prepay discounts are not offered with invoices paid by credit card.

FREIGHT ALLOWANCE

Any individual shipment having a sale price of $2,000.00 qualifies for our pre-paid freight allowance policy. Freight prepaid discounts may be taken at the time of payment if the invoice is paid within the established credit terms. SmartDC reserves the right to select best transportation method for orders qualifying for freight allowance. Customer may select alternative shipping services (including expedited services) but will assume all costs.

MISSING AND DAMAGED ITEMS

All damaged or missing items must be reported to factory within 48 hours of receipt of order.

RETURN MERCHANDISE

Return will be accepted only in re-saleable condition in original packing. Returns will not be accepted without prior authorization from SmartDC in the form of an RMA number. Debit memos are not accepted. Custom products are not returnable. Returned value must be greater than $100.00. Return requests must be within 90 days of date of shipment. Factory credit will be issued based on the original invoice price, less restocking and/oreconditioning charge of up to 30%. Return freight is the responsibility of the customer or will be deducted from the credited amount.
